TERMS, REFUND & SUBSTITUTION POLICY

Effective Date: January 26, 2026


1) ACCEPTANCE OF TERMS

By placing an order on USAToolsInc.com, the customer agrees to all terms outlined in this Terms, Refund & Substitution Policy. These terms govern all purchases, returns, refunds, substitutions, warranties, order fulfillment practices, shipping terms, and related services provided by Race Car Tools, Inc., d/b/a: USA TOOLS (“USA TOOLS,” “we,” “our,” or “us”).


2) ORDER PROCESSING AND PRODUCT AVAILABILITY

Orders are processed in the order received. Product availability may vary due to manufacturer inventory, distributor stock, fulfillment partner availability, or supply-chain conditions.

USA TOOLS reserves the right to cancel and refund any order that cannot be fulfilled, is delayed beyond a reasonable timeframe, or is affected by pricing/inventory errors.


3) PRICING, ERRORS, AND ADJUSTMENTS

Prices are subject to change without notice. If a pricing error, listing error, or system error occurs, USA TOOLS may cancel the order and issue a full refund.

3.1 Tariff, Freight, and Shipping Cost Adjustments

Due to fluctuations in tariffs, carrier surcharges, fuel costs, and shipping rates, the final cost of an order may change after checkout but prior to shipment.

If there is a significant increase in product cost, freight charges, tariffs, or shipping rates before the order ships, USA TOOLS may contact the customer to request approval of an adjusted total. If the customer does not approve the revised charges, the order may be cancelled and refunded.


4) REFUND AND RETURN POLICY

4.1 Return Eligibility (Limited Return Program)

Returns are accepted ONLY under the following conditions:

  • Item was damaged in transit

  • Item was defective upon arrival (DOA)

  • Incorrect item was shipped (different from what was ordered)

Customers must notify USA TOOLS within seven (7) days of delivery if an item arrives defective, damaged, or incorrect. Supporting photos and/or video evidence may be required before a return authorization is issued.

Returns are NOT accepted for buyer’s remorse, accidental orders, pricing disputes, or price differences between retailers or marketplaces.

4.2 Return Authorization Required (RA / RMA Number)

A Return Authorization (RA/RMA) number must be issued before any return is shipped back.

Items returned without authorization or without an RA/RMA number will not be accepted and will not be refunded. USA TOOLS reserves the right to refuse delivery of unauthorized return packages or return them to the sender at the customer’s expense.

4.3 Condition of Returned Items

Returned products must be in the original packaging, unused, uninstalled, and in resalable condition unless the item was defective or damaged upon delivery.

All accessories, manuals, included components, and packaging materials must be returned.

If returned items are missing packaging, parts, manuals, accessories, or included components, USA TOOLS may deduct fees to cover replacement/repackaging costs or may refuse the return entirely.

4.4 Verification and Inspection Process

All claims of product defect, incorrect shipment, or product mismatch are subject to verification, inspection, and/or manufacturer confirmation.

If inspection shows that the item:

  • is not defective,

  • matches the website listing specifications,

  • was damaged due to misuse, installation, improper handling, customer error, or improper storage,
    then the return may be refused or may be subject to restocking fees and/or return shipping charges.

4.5 Non-Returnable and Non-Refundable Items

The following items are non-returnable and non-refundable, including but not limited to:

  • Electrical or electronic diagnostic equipment (once opened)

  • Special-order items

  • Installed or used tools

  • Paint guns and spray guns

  • Gasoline-powered equipment

  • Items damaged by misuse, improper handling, installation, or modifications

  • Noregon hardware and/or software products

IMPORTANT: All sales of Noregon equipment, software licenses, renewals, subscriptions, and related digital products are final and cannot be cancelled, returned, exchanged, or refunded under any circumstances.

4.6 Refund Method

Approved refunds are issued only to the original payment method.

Original shipping charges are non-refundable unless the return is caused by an error made by USA TOOLS.

4.7 Return Shipping Costs

Unless otherwise stated in writing, the customer is responsible for all return shipping costs.

For freight/LTL shipments, the customer is responsible for all freight charges, including liftgate fees, residential delivery fees, appointment fees, storage fees, redelivery fees, and all return freight charges.

4.8 Restocking Fees

If a return is approved for a non-defective item (when allowed), it is subject to a minimum 15% restocking fee and may be up to 25%, depending on manufacturer return requirements and product condition.

Restocking fees cover inspection, repackaging, processing, administrative handling, and manufacturer return penalties.

USA TOOLS may waive or reduce the restocking fee at its sole discretion.

4.9 Refused or Undeliverable Packages

If a package is refused, returned as undeliverable, or returned due to an incorrect address provided by the customer, any eligible refund will be reduced by:

  • Original shipping cost

  • Return shipping cost

  • Applicable restocking fee (15% to 25%)

4.10 Order Cancellations

Orders that have already been processed, packed, or shipped cannot be cancelled.

If cancellation is requested after processing but prior to shipment, a processing fee may apply.

If an order has shipped, it must be handled as a return (if eligible) and will be subject to all applicable fees, including shipping charges and restocking fees.

4.11 Price Differences on Other Platforms (Amazon, Marketplaces, or Retail Sites)

USA TOOLS strives to offer competitive pricing. However, price differences between our website and third-party retailers, marketplaces, or resellers (including Amazon and similar platforms) do not qualify as a reason for a return, refund, price adjustment, or partial credit after purchase.

Marketplace prices are subject to constant fluctuations, limited-time promotions, and seller-specific pricing policies.

4.12 “Not as Described” Claims, Misrepresentation, and Return Abuse Prevention

USA TOOLS does not approve returns based solely on customer preference, price comparison, or buyer’s remorse.

If a customer submits a return request claiming the product is “not as described,” USA TOOLS may require additional verification including, but not limited to:

  • Photos and/or video of the item received

  • Photos of packaging, labels, and serial/model numbers

  • Confirmation of the product application, specifications, or compatibility

  • Manufacturer verification when applicable

If our review confirms that the item matches the listing description, model number, and specifications, the return may be denied.

USA TOOLS reserves the right to refuse returns, limit return privileges, or cancel future orders if we determine there is abuse of return policies, including repeated returns, misrepresentation of return reasons, item swapping, or other fraudulent return activity.

4.13 Drop-Ship Fulfillment Notice (Third-Party Shipping Partners)

Some items may be fulfilled and shipped by authorized distributors, manufacturers, or third-party vendor partners.

Fulfillment source may vary and packaging or shipping labels may differ from USA TOOLS branding. This does not affect product authenticity or warranty coverage unless otherwise stated.

All returns must follow USA TOOLS return procedures and require an RA/RMA number.

Do not return items directly to any marketplace, carrier, distributor, or third party (including Amazon). Unauthorized returns will not be accepted or refunded.

4.14 Third‑Party Fulfillment & Marketplace Pricing

Some orders may be fulfilled directly from third‑party suppliers or authorized distributors, including but not limited to Amazon, eBay, Walmart, or manufacturer‑direct warehouses. This ensures faster delivery and product availability. The source of fulfillment does not affect the condition, authenticity, or warranty of the item.

Price differences between USA TOOLS and any third‑party marketplace do not constitute a defect, misrepresentation, or valid reason for return. Customers who choose not to purchase an item from another marketplace at a lower price are not eligible for returns based solely on price comparison or packaging differences.

All returns must comply with our posted Return Policy, including return shipping responsibility and restocking fees where applicable.


5) SUBSTITUTION POLICY

5.1 Factory-Refurbished Substitution (OEM Refurbished)

In rare circumstances, USA TOOLS may fulfill an order with a factory-refurbished item when a new item is unavailable.

Factory-refurbished items must be refurbished by the original manufacturer or an OEM-authorized facility, be functionally equivalent to new, and include the same manufacturer warranty as a new unit.

This substitution may be made without additional customer approval.

5.2 Manufacturer-Authorized Refurbished Substitution

If a new or factory-refurbished item is unavailable, USA TOOLS may ship a manufacturer-authorized refurbished item, refurbished by an OEM-approved service center, meeting OEM performance specifications, and including the same OEM warranty coverage.

This substitution may be made without additional customer approval.

5.3 Seller-Refurbished Option (Customer Approval Required)

If no new, factory-refurbished, or authorized-refurbished units are available, USA TOOLS may offer a seller-refurbished option only with the customer’s explicit approval.

Seller-refurbished items include a six (6) month USA TOOLS warranty covering defects in materials and workmanship.

If the customer does not approve the seller-refurbished option, the order will be cancelled and refunded.


6) DISCONTINUED OR BACKORDERED ITEMS

If an item is discontinued or unavailable for an extended period, USA TOOLS may, at its discretion:

  • Offer an equivalent or upgraded model

  • Offer a factory-refurbished or manufacturer-authorized refurbished unit

  • Offer a seller-refurbished unit with customer approval

  • Cancel and refund the order


7) SHIPPING AND DELIVERY

7.1 Lost or Damaged Shipments

Customers must report shipping damage or loss as soon as possible. Carrier claims must be filed within the carrier’s required timeframe.

USA TOOLS may assist with claims, but USA TOOLS is not responsible for carrier negligence, delays, theft after delivery confirmation, or loss due to incorrect address information provided by the customer.

7.2 Export Orders (International Shipments)

For export orders, the customer is responsible for all tariffs, duties, customs fees, import taxes, brokerage fees, and any other charges assessed by the destination country.

USA TOOLS does not collect or estimate these charges at checkout. Refusal to pay these charges may result in the shipment being returned, abandoned, or destroyed by customs.

All associated costs will be deducted from any eligible refund.

7.3 Proof of Delivery and Delivery Responsibility

Orders are delivered to the shipping address provided by the customer.

If USA TOOLS provides carrier proof of delivery, the order is considered delivered and complete.

Delivery includes packages left at the front door, porch, mailbox area, loading dock, reception area, or any location designated by the carrier or recipient.

Claims of non-receipt must be made directly with the shipping carrier.


8) WARRANTY INFORMATION

8.1 Manufacturer Warranty

Most products include a manufacturer warranty. Warranty claims must be handled directly with the manufacturer unless otherwise stated in writing.

8.2 USA TOOLS Warranty (Seller-Refurbished Items Only)

Seller-refurbished items approved by the customer include a six (6) month USA TOOLS warranty covering defects in materials and workmanship.


9) LIMITATION OF LIABILITY

To the fullest extent permitted by law, USA TOOLS is not liable for incidental or consequential damages, loss of business, downtime, installation costs, labor charges, or damages resulting from improper installation, misuse, customer error, or inability to use the product.

USA TOOLS total liability is limited to the purchase price of the product.


10) GOVERNING LAW

All transactions, disputes, and claims are governed by the laws of the State of Florida, without regard to conflict of law principles.
